The iSinkwaMtase Marketing System (the "System") is a private, single-operator software tool used by the artist project iSinkwaMtase (the "Operator") to automate marketing, public relations, and content publishing for the Operator's own music releases. It is not a public-facing product, not offered to third parties, and not available for sign-up.
These Terms of Service govern any use of the System and its hosted endpoints
at https://marketing-system-ebon.vercel.app and related
subdomains.
Access to the System is restricted to the Operator and any individuals explicitly authorised in writing by the Operator. Unauthorised access, reverse engineering, or attempts to use the API endpoints without a valid API key are prohibited.
The System interacts with the following third-party platforms on the Operator's behalf, using OAuth tokens or API credentials issued to the Operator's own accounts:
Use of those platforms through the System remains subject to each platform's own terms of service and developer policies. The Operator is responsible for complying with those policies, including but not limited to platform-specific content rules, rate limits, automation policies, and attribution requirements.
All marketing copy, music, imagery, video, and other content generated by or published through the System originates from the Operator. The Operator warrants that they hold the necessary rights, licences, and clearances for any content the System publishes on their behalf, and accepts full responsibility for the lawfulness and accuracy of that content.
The System uses generative AI (currently Anthropic's Claude models) to draft copy and pitches. AI-generated drafts are reviewed by the Operator before being sent to high-stakes recipients (press, curators, DJs). The Operator remains the author of record for all content published through the System.
Where the System sends emails (for example, press pitches to journalists and editors), it does so under the Operator's authority and identity. The Operator commits to:
The System's source code is the property of the Operator. All third-party trademarks — including but not limited to Spotify, Meta, Instagram, Facebook, TikTok, X, Google, and Anthropic — remain the property of their respective owners and are used here solely for descriptive purposes.
The System is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. The Operator does not warrant uninterrupted operation, freedom from errors, or specific marketing outcomes.
To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the System.
These Terms may be updated from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the System constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
